OSFI would like to remind plan administrators that subsection 10(1) of the Pension Benefits Standards Act, 1985 the “PBSA”) requires plan administrators to file a copy of every document that creates or supports the plan or the pension fund and section 10.1 of the PBSA requires the administrator to file, within 60 days, any amendment to any of these documents.
Failure to file current and complete versions of the documents supporting the pension plan, (e.g. trust agreements or custodial agreements) can result in delays for approval for certain pension plan transactions.
